This relationship leads to conflict between management & employees as both adopting policies to each other (Gallie et. al. 1998; Kelly; 1998). Unions' voice through effective communication between management and employees and the resolution of employee grievances lead to improved relationship with employers (Freeman & Medoff, 1984). Union effects on employment relations depend on their monopoly and voice role. Future unions' relationship may lie on their emphasis on their voice role (Rubinstein 2001; Wachter 2003). Bargaining arrangements mediate the relationship between unions and perception of employment relations for various reasons. Fernie and Matcalf (1995: 401) agree "the benefits from having a union representation the bulk of the labour force in a work force flow from greater voice and representativesness and less fragmentation of work place employee relations." Analyzing employer perceptions of employment relations in the Workplace Industrial Relations Survey (WIRS, 1990), Fernie et al. (1994:17) found "multi unionism contributes to inferior relations between management and labour." If workers are close substitute, employers could use fragmented bargaining arrangements to 'divide and rule' them (Horn and Wolinsky, 1988). If they are highly complementary this eventuality does not arise and separate unions or bargaining arrangements may promote better relations by providing voice arrangements for different groups of workers. Unions may obtain a premium where bargaining coverage in high or multiple unions are present (Forth & Millward, 2002). (Zack, 1999) This would help to find the link between knowledge and strategy. In this approach, analysis is done with the help of SWOT (Strengths, Weaknesses, Opportunities and Threats) that helps identifying the gaps in an organizations knowledge. This would help the organization to find out where the knowledge which can be used and where can it be used to improve its competitive position. This is achieved by analysing the organisations knowledge position along two dimensions: Exploration vs. Exploitation It refers to the area where the organization needs to improve and develop its knowledge in vs. the opportunity it may have to use the unused knowledge unexploited resources. Internal vs. External Knowledge This refers to if the knowledge is within the organization or outside. The organization has different levels of management and follows a formal culture. Hence there is not much communication between the levels which leads to lack of knowledge sharing within the departments of the company. For instance A few years ago Nestle UK realized the gap of knowledge was the teams of lean experts, there was often a limited lean knowledge base that retained their knowledge within factory management levels. While other managers, such as those in accountancy and engineering, came with a specialist body of knowledge about the fundamentals of their discipline that was gained from their initial professional education and on-going development, the operations and manufacturing managers often did not have the same â€Å"focused† training structure. As a result, many had just not had the opportunity to develop a detailed grounding in modern manufacturing tools, techniques and practices. The company has not been able to achieve its goal with of being a completely decentralized organization where delegating decisions and giving authorities to lower levels are considered. The company has a Hierarchical culture, where there are a few levels of management but has broad spans of control and is rule based and formal. The main purpose of the software is to help the flow of information between all business functions within the organization and also manage connections outside stake holders. Businesses use a large number of softwares and processes and introducing an ERP system which is usually complicated impose some serious changes in the staff work. SAP is the kind of ERP system Nestle uses. In fact, Nestle uses five modules of SAP namely, purchasing, financials, sales and distribution, accounts payable and accounts receivable. SAP systems are used for accessing, distributing and sorting the information. Manugistics Supply Chain system is currently used by Nestle for automating its supply chain operations. Intranet is widely used technology by almost all the organizations in the world. Sharing information amongst different departments is easier with the help of intranet. B.F. Skinner Skinner believed in Behavioristic theories. When studying behaviorist theories you investigate the role of learning in the development of personality. The psychologist study conditions and situations that affect the learning of behavior. Skinner defines personality in terms of behavior. B.F. Skinner was born March 20, 1904, in the small Pennsylvania town of Susquehanna. His father was a lawyer, and his mother a strong and intelligent housewife. His childhood was old-fashioned and hard-working. He wanted to be a writer and did try, sending off poetry and short stories. When he graduated, he built a study in his parents’ attic to concentrate, but it just wasn’t working for him. At Harvard he got his masters in psychology in 1930 and his doctorate in 1931, and stayed there to do research until 1936. He was perhaps the most celebrated psychologist since Sigmund Freud. His first theory was of reinforcement. When a behavior is reinforced, or rewarded the chances of that happening again are likely. He is saying by reinforcement if the person knows they will get rewarded for it they will continue to do it. Skinner noted that the learning process should be divided into "a very large number of very small steps and reinforcement must be contingent upon the accomplishment of each step." Skinner also stated that by making the steps of learning small, the frequency of reinforcement can be increased and the frequency of being wrong is reduced. Another theory was that of punishment. He says in this way he does not approve. Skinner says that punishing a child for something will make him not do it again and that is good in some cases, but what if your parents are abusive. He says that the theory of rewarding is the way to go and punishment is not strengthening behavior, it is lessening the likelihood of that behavior to happen again.

TOTAL QUALITY MANAGEMENT Total Quality Management formally known as total quality control emphasizes the crucial role of management in the quality process and utilizes a combination of methods, theories, techniques, and quality guru strategies for achieving world-class quality. TQM is not a complete solution formula as viewed by many but a lasting commitment to the process of continuous improvement. Total quality management is not a fad of the times, but rather a correction of the previous failures in management combined to produce a better management style when used appropriately (http://www. ejs. com, retrieved August 1, 2009). The word â€Å"total† in Total Quality Management means that everyone in the organization participates in the overall effort in process improvement. Quality means meeting or exceeding customer (internal or external) expectation and management means improving and maintaining business processes or activities. Communications, cultural transformation, par ticipative management, customer focus and continuous improvement are the five basic elements of TQM. Communication is the exchange of information and understanding between two or more people. There is communication if the information is received and understood. A company will not be successful if it will not listen to employees and to its customers. If there is on fundamental principle of TQM, it is that quality is what the customer defines it as, not what the organization defines it to be. TQM calls for a cultural transformation which requires a high level of workforce engagement wherein people do their utmost for the benefit of their customers and for the success of the organization. Cultural information implies that all employees must change their traditional way of thinking about business. It is a cultural change for everyone to be responsible for quality. For the past years, quality was viewed as a manufacturing problem only, but it has now become a service issue as well. TQM is a philosophy that prevents poor quality in products and services. A company vision that defines and supports quality must be shared by anyone in an organization. TQM also involves Participative Management Style where managers develop genuine partnership with the workforce and they both contribute to achieving quality. This management philosophy is often misused by management as a way of avoiding responsibility. Managers using this philosophy must be leaders, take the initiative, and accept responsibility for giving orders or making decisions. Participative management can be best achieved through empowerment and involvement. Every member of the organization gives their views and suggestions regarding improvements and the combined thoughts and ideas will be evaluated by the empowered associates who have the authority to make decisions and to take actions in their work areas without prior approval while willingly supported by the executives and managers. The pursuit of TQM must emphasize customer focus which is an important factor in an organizational survival or demise. Organizations depend on their customers and therefore should understand current and future customer needs, should meet customer requirements and strive to exceed customer expectations. The last element of TQM is the continuous improvement which should be a permanent objective of the organization in its overall performance. Applying the principle of continual improvement typically leads to employing a consistent organization-wide approach to continual improvement of the organization's performance, providing people with training in the methods and tools of continual improvement, making continual improvement of products, processes and systems an objective for every individual in the organization, establishing goals to guide, and measures to track, continual improvement, and recognizing and acknowledging improvements. How to have a relationship Essay

? A relationship is a way of connecting. The connection could be between people or objects. Listening to my grandmother talk about relationships helped me understand how things have completely changed over times. My grandmother stated that relationships where more valued back then and people stayed together for all the right reasons. She informed me that when you loved someone you loved them like no other. When it came to marriage they lasted longer than they do now. Having a relationship with someone was the thing to do. At one time relationships actually had meaning people were with each other because they loved them. This showed me the commitment part of relationships, when people actually stayed faithful to the person they were with. Nowadays men and woman say I love you just for the fun of it. But be honest everyone you know or knew either ant’s a relationship, has a relationship or has played a role in one either as the main lover or the sideline. Relationships are complicated, complex commitments that we take seriously or play around with like a rag doll. Serious relationships start from the mind knowing what it is that you want how you want it and how you’re going to get it is the first step in committing to a relationship. Yes commitment can be very hard to do. Especially when were accustomed to doing things our own way; without having to answer to someone else. Understanding the person you are trying to commit to is a good way to start a serious relationship. It is important to gather as much information as possible and take as much time as needed to ensure that you know the person that you are in a relationship with. Taking the steps and looking at past relationships can help you understand if the relationship might be what you are looking for in life. It is true that no matter how long you have known a person you may never truly know who that person really is. It is also important to know what we want before committing ourselves in. Whether that relationship is a marriage or just a boyfriend/ girlfriend committing to someone should begin with feelings being involved. Relationships become complicated when you have disagreements, other people etc. I feel that it takes two to make a relationship work and if both parties are not commented then it will never work. It’s like the eighty-twenty rule which explains that one person is giving there all and all and the other person only gives what is necessary at that time. How can a relationship work if both parties are not on the same level and are not committed to each other? Complicating in relationships come from problems that we cause ourselves, from not committing or giving our all to the relationship. As for myself I’ve had a few relationships in my day. Some good ones and then some that I would give anything to take back and wish that I had never committed myself to. Not saying that you would have the same outcome as I did but just make sure that the love is real. If we go into a relationship knowing that we are not there for a long time then it makes the relationship less complicated. In these type situations just make sure that you inform the person with how you feel before going into the relationship. It is important to have a clean understanding of what each party wants. Having false feelings in a relationship can be the most hurtful thing when you actually find out so therefore try to avoid coming into these situations. Communication is a huge part of a serious successful relationship. Communicating with your partner is a very good stress reliever and understanding method. Having communication builds trust and loyalty, which are two other things that are very important in a relationship. When a person is in a relationship they expect their partner to be understanding, have good listening skills and be there when they need you. Sometimes it’s just best to sit back and listen to what the other person had to say. You never know what you might learn about your partner if you just listen. Always remember to keep the lines of communication open throughout the relationship. For me, I think that one of my biggest downfalls in previous relationships is the lack of communication between my partner and me. I also have problems with my partner not being able to support himself and maybe even helping me every now and then, don’t get me wrong I’m not asking him to take care of me in no means what so ever but help every now and then would be good. As I did research on the topic of relationships, I learned that there are several steps that can be taken to have a successful relationship. First it is important to ensure that you trust your partner. Does your partner’s communication lift you just to bring you right back down? How do you and your partner deal with conflict in your relationship? Do you have compatible financial values? When you are thinking about starting a new relationship think about some of these questions. They might help you to understand the relationship better and if that’s what you really want. Maintaining a trusting and lasting relationship is going to require some work on both sides and especially in these times. As long as there is trust and communication between both parties then there is a good chance that the relationship will work. I plan to take my time and know the person that I intend to be in a serious relationship with. I don’t want to hurt anyone and I definitely don’t want to be hurt. I look forward to finding love one day that is meaningful and lasting but until then I will continue to inform my partner how I feel and what I am looking for in the beginning. I will ensure the line of communication stays open.

Types of Speeches There are different types of speeches; the first is core political speech the most guarded form due to its communicative nature and its function to a republic that is functional (Mike 65). It is a speech about political issues and ideas that are not motivated by profit; the restrictions in this kind of speech must be well analyzed or else they can be struck down. Another kind of speech is commercial speech, in this kind it is not wholly protected although it is regulated by the state (Mike). There are some exceptions to freedom of expression. Many of these have been identified by the court and in many cases without controversy. Courts justified them as speeches which could harm the public or speeches that the fore fathers had no intention of protecting or just customs that had been part of common law tradition from England where the American legal system is derived. Exceptions Obscenity is one of the exceptions, according to the US Miller Test, obscenity is a test used by Supreme Court to determine if an expression or a speech can be termed obscene and whether it can be protected by the first amendment of the constitution (Tedford 124). Using a triangular file to make FOUR oppositely-placed small grooves into the edge of the penny (the marks with be approximately 90 degrees apart. The grooves must be deep enough so that the zinc is exposed, but not so deep that the pennys mass is greatly affected. 4. Clean the top and bottom surface of the penny with steel wool until it’s shiny. Rinse the penny in acetone and dry it on paper towel. 5. The Changing Face Of Youth Transitions Social Policy Essay Whether a young person is from a richer or poorer family may determine the age and the level of difficulty of going from a young person to an adult. The definition of youth transition seems vague. It generally means the time period when young people take increasing responsibility for themselves, their relationships and the decisions about their lives that shape their future prospects (HM Treasury, 2007). It is a principle that can be applied that to several key areas of adulthood, such as transition from education to work, moving out from home and starting a new family. The aim of this essay is to look at how social background could affect how long the speed of someones transitions in the mentioned areas. It will attempt to come to a conclusion afterwards. For simplicity, social class will be divided into working-class and middle-class. First of all is the transition from education to work. The main theory linking social class with this transition is that adolescents from middle-class backgrounds are more likely to stay in education at university level than youths from less well-off backgrounds. This could be because of more than one reason. This is because a persons level of education is likely to affect their childrens. For example, a mother from the working-class probably would not have had a higher education and may not have performed well in school as a child or adolescent herself. As a consequence, she may not have seen education as important as a parent from a middle-class background. This could possibly affect her childs education in two ways. The first way is that the parents unfavourable attitude towards education means that they are unlikely to encourage their child to pursue a university education. This is referred to by Jones (2002, p.9) as cultural capital. The second way is that parents who did not do well academically might have, as a result, low expectations of their children, expecting them to be similar to their parents. This would also mean parents not favouring university education. The importance of these two relationships between a parents social background, cultural capital and low expectation, is that children who do not study at university level (normally a three year course) are likely to get some form of employment sooner than those who go to university. For the same reasons, teenagers from wealthier backgrounds probably have better educated parents and are, perhaps, expected to attain a university degree. From this, it can be said that social class may influence the timing of transition to adulthood as children from less well-off backgrounds are more likely to move from education to employment earlier than those from middle-class backgrounds. It can also be said that this transition is made earlier and easier for working-class youths simply because their parents cannot afford to pay for their university fees. Therefore there is little choice for them but to get a job. This is another example of the influence of social class. Teenagers from a wealthier background could have the option to delay transition into work by furthering their qualifications at university, because there is money available from their parents or other sources. On the other hand, however, this theory is may not be very convincing. This is because there is usually financial aid available to those who do not have the money themselves, such as government loans, grants and university bursaries. According to Jones (2002), 68% of student income is from loans. This suggests that a high amount of higher education students are from backgrounds that cannot themselves afford it. The relevance of this is that it gives the impression that the influence of social class on transition from education to work is minimal, as many working-class children are also pursuing higher education in recent times. It is also crucial to consider domestic youth transitions. The first is the change a young person experiences from living in their parents houses to living independently. Living independently means that the adolescent is living in accommodation financed by his or herself. This links together with the education-employment transition as university students, although most of them are living away from home, are not living fully independently because it is most likely their parents who are responsible for their childs education and university accommodation fees. It was claimed earlier in this essay that middle-class adolescents are expected to go to university more than those from a poorer background. From this it could be said that the moving from home transition may occur earlier for those from the working-class as they will go into employment sooner than those from wealthier backgrounds. The relationship between social class and standard of living may be important. Using economic intuition, it can be said that higher income and wealth leads to a higher standard of living as more luxury goods and services become affordable. Therefore young people from middle-class backgrounds would enjoy a higher standard of living than youths from working-class backgrounds. This is surely influential over the time and ease of the transition of leaving home. This is because high living standards may reduce the incentive for young people from middle-class backgrounds as they are enjoying a higher quality of life while living with their parents. It is probable that moving away from home and earning their own living would reduce their quality of life as they will not be able to afford it in the short-term. Those from working-class background, however, do not have this quality of life and therefore have more reason and enticement to move out of home and aim to make a better living from hi s or her self. Another domestic transition is a youth going from their family of origin to starting a new family. This could mean having children. Before this, it is important to consider why a young woman would have a planned pregnancy. According to Carter and Coleman (2006), an unsettled childhood can be a key factor in this fast-track transition. Separation of parents and domestic violence are usually more associated with people of working-class background than any other. It can be claimed that teenagers that have separated parents and difficult family relationships desire a baby to achieve more stability in their lives something which they believe being a parent may bring. An unsettled background could also result in the youth abandoning home. This suggests that teenagers from less-wealthy backgrounds may make the family transition or the leaving-home transition earlier than those from richer families. Another theory is that poor educational achievement and bullying may prompt young women to c hange to a different life course such as parenthood (Carter and Coleman, 2006), but it is difficult to link this to social class. In fact, the issues of separated parents and domestic violence affect middle-class families too, undermining the strength and validity of the previous point. From the analysis above, it can be said that social class seems to have some influence over the timing and ease of youth transitions. It appears that all the mentioned transitions employment, moving out of parental home and parenthood seem to happen earlier and with more ease for children of working-class background. However, it is difficult to conclude the extent to which social class affects youth transitions. There are also other factors that need to be looked at such as the individual characteristics of a young person or the role of ethnicity in youth transitions (Cassidy. et al, 2006). Overall, social class might has some influence over the timing and ease of youth transitions through the family situations, academic expectations and living standards typically associated with that particular social background. Comparing Themes in Cat’s Cradle and Slaughterhouse Five  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Throughout his career, Kurt Vonnegut has used writing as a tool to convey penetrating messages and ominous warnings about our society. He skillfully combines vivid imagery with a distinctly satirical and anecdotal style to explore complex issues such as religion and war. Two of his most well known, and most gripping, novels that embody this subtle talent are Cat's Cradle and Slaughterhouse-Five. Both books represent Vonnegut’s genius for manipulating fiction to reveal glaring, disturbing and occasionally redemptive truths about human nature. On the surface, Cat’s Cradle and Slaughterhouse-Five are dramatically different novels, each with its own characters, symbols, and plot. However, a close examination reveals that both contain common themes and ideas. Examining and comparing the two novels and their presentation of different themes provides a unique insight into both the novels and the author – allowing the reader to gain a fuller understanding of Vonnegutâ₠¬â„¢s true meaning. One of the most prevalent themes in Vonnegut’s works is religion. In the early pages of Cat’s Cradle, Vonnegut submits his contention that "a useful religion can be founded on lies (Vonnegut, Cats Cradle 16)," meaning that, fundamentally, religion is about people, not about faith or God. Reminiscent of Karl Marx’s description of religion as the "opiate of the masses," he describes all religions as mere collections of "harmless untruths" that help people cope with their lives. The Book of Bokonon in Cat's Cradle represents this portrait of religion at both its dreariest and its most uplifting, Bokononism is contradictory, paradoxical, and founded on lies; its followers are aware of this... ...refree tone highlights them by providing irony and contrast. This unparalleled ability to seamlessly combine a light tone with serious theme is what distinguishes Kurt Vonnegut from other writers, Although Cat's Cradle and Slaughterhouse-Five share common themes, the presentation of each of the themes is different in each book. The two novels complement each othe, and comparing both can provide a higher level of understanding for each. Vonnegut never forces his opinions - he makes statements by asking questions, and presents his themes through subtle, but powerful stories, His goal is to get readers to re-examine, not necessarily to change, their lives, morals, and values. Themes such as death, war, and religion are as old as literature itself, yet Vonnegut adds a unique twist to them, inviting the reader to look at these issues from an entirely new perspective.

Breaking the Norms  Ã‚  Ã‚  Ã‚  Ã‚  When each of us was conceived, we did not have anything influencing our perception of the world. While we were growing up and still do this day, our surroundings influenced the way we think and the how we behave in our daily lives. We get ideas about gender roles from our parents, our teachers, television, books and even subconsciously. As part of a project to break the norms of society and push past peoples thresholds, I needed to figure out what made people feel uncomfortable. I thought for a moment and decided to tackle homophobia. I choose this topic because very few men are comfortable talking about the subject of gay men. It is my objective to better understand why men think the way we do. In order to get started I needed to brainstorm.   Ã‚  Ã‚  Ã‚  Ã‚  After a little bit of deliberation, Juan and some other male classmates decided to hold hands and walk through the student union. Picture four grown men holding each others hands, walking through the middle of campus. As you can imagine, we received a lot of looks. We walked around for about five minutes as if nothing was going on. People seemed to be staring at us for a moment saying to themselves â€Å"what are they doing?† This is something that never happens in society. You hardly ever see men holding hands, much less four grown men swinging each others arms. Honestly, my first thought was that we would look so gay if we did this. Others in the group were skeptical at first to do this as well. When we walked into class, the students seem to cringe when they saw us take our seats.   Ã‚  Ã‚  Ã‚  Ã‚  After that day I decided to take my project one step farther and push past everyone’s threshold. In order to break the norms of society and truly make people uncomfortable, I decided to wear the color pink for the entire day of school. I went to the local Savers and purchased several items that were very feminine. I bought a pair of pink and yellow striped bellbottoms and a tight pink collared shirt. I wore the clothes to school in the hopes to witness the students reactions to me wearing clothes completely out of the ordinary. After attending two classes that day, I decided to talk to some friends of mine. They all told me that I looked like a â€Å"fag.† I finally had broke the norms of society and at the same time caught my friends stereot... ...ey take it in the rear!† Some of the men I asked even said they felt â€Å"homosexuality is like a disease that you might rub off on you if you get too close.† Many of these men felt like their families would disown them. My feeling is that if you are not gay then you have no reason to be afraid of someone who is. I feel that if you have no doubt in your sexuality then you wouldn’t feel threatened by someone who is.   Ã‚  Ã‚  Ã‚  Ã‚  I don’t feel that men are truly independent or confident enough to let go and feel as comfortable as females do. I feel that the social construction of our society needs to be modified. Men need to be taught that it is okay to show emotion and that whatever their sexuality is, it doesn’t matter. To be more masculine we should learn to cope with our sexuality, and not be afraid. Masculinity does not mean without feeling, it means being strong and coming to terms with who you are. Wearing a pink shirt or holding hands with someone doesn’t mean anything then just that. With so many influences changing our perception of the world, its hard to make the right choices. You should not be so quick to judge someone, and in this case, why does it matter?

Courtroom Visit Essay

The Judiciary’s role is to give everyone fair access to the courts to solve legal problems fairly and efficiently, decide justly the guilt or innocence of anyone charged with a crime, and interpret the laws and protect the rights and liberties guaranteed by the Constitutions of California and the United States. Criminal court is where you go when the state believes you have committed a crime and it files charges against you. The Criminal Court has jurisdiction over infraction, misdemeanor and felony cases. The Criminal Court conducts trials, motions, arraignments, preliminary hearings, probation hearings, mental health proceedings, and other types of criminal proceedings. In this essay I will be discussing my visit to the Orange County Courthouse in Santa Ana on March 26, 2014 and my observations of the criminal proceedings in Department C58. In the courtroom were the public defenders, the district attorneys, private attorneys, court clerks, a court reporter, a bailiff, a resident probation officer, the judge, in custody defendants, out of custody defendants, spectators in the audience and when needed an interpreter. The defendants were charged with a variety of different crimes including petty theft, drunk in public, under the influence of a controlled substance, possession of paraphernalia and more serious crimes including possession of a controlled substance for sales, possession of a fire arm, commercial burglary, forgery, fraud and counterfeiting as well as probation violations. The judge took the bench at around 9:30 am and started with the defendants that were charged with misdemeanor offenses. The judge called each defendant’s name; each defendant would step up to the podium, the judge then gave notice of the charges the defendant was currently being accused of. On several occasions the judge called the name of a defendant that was not present, she then issued an arrest warrant for the defendant, revoking their current bail, in some cases a new bail was set but the majority of the warrant’s had no bail amount. For the defendants that were present out of custody the judge would offer the defendant a sentence for the charges and asked for the defendant’s plea to the charges. If the defendant wished to plead not guilty to the charges, which commonly occurred, the judge then appointed the public defender’s office to represent the defendant for the  matter. In several cases the defendants were charged with a misdemeanor including under the influence of a controlled substance (HS 11550 a), possession of paraphernalia (HS 11364), petty theft (PC 484 a) and drunk in public (PC 647), these defendants provided the county with a sample of their DNA, they were required to pay a $75 collection fee and then charges against them were dismissed. After the judge completed the misdemeanor cases she moved on to the felony cases, which were more complex. Just like with the misdemeanor cases, the judge would call the name of the defendant and have them step up to the podium, she would then give them notice of the charges against them and ask if they were able to afford an attorney if they were not able to do so she then would appoint the public defender’s to represent the defendant. The cases that I observed were in a variety of different stages of the criminal case proceedings. Theses stages included arraignments, pre trials, preliminary hearing and sentencing. In most of the cases the judge would calendar the case for a further date. In these cases the defendant is notified of their constitutional right to a speedy trial and in order to set the case for a continuance the defendant had to agree to waive this right. The defendant’s that decided to plead guilty to their charges were notified of their constitutional rights that they would be giving up by pleading guilty to the charges these rights included the right to a jury trial, their right to a speedy trial and their right to confrontation. The judge sentenced the defendant’s to a variety of sentences including fines, restitution, diversion programs, classes, county jail time, probation and state prison. The defendant’s that were in custody and were sentenced to jail time the judge would notify the defendant of his actual credits and his good time and give the defendant how many credits he/she had towards their sentence. If the defendant’s sentence included probation, the defendant had to agree to the terms and conditions of their probation and the judge reviewed the rights that they were giving up to be placed on probation, including the right to own a fire arm and the defendant’s search and seizure rights. In conclusion, I found my courtroom visit to be great learning  experience. More specifically after visiting the courthouse and seeing our criminal justice system firsthand, I feel that I have a greater understanding of the different topics we have been learning about in class including the different stages of the criminal court proceedings, the constitutional rights each person has when charged with committing a crime and the different people involved with the criminal courts.

Good Mothers Bad Gang

Anita Anderson Dr. Mike Calvert Teenage Wasteland 18, July 2011 Good Mom/Bad Gang Kids on the street, parents that don’t care, looking for a sense of family or belonging; do you see a child at risk? While in some cases this may be true, in many instances this is not the case. In her article â€Å"Mothers, Sons, and The Gangs† Susan Horton tells of three different gang members and their families. Although the families had different backgrounds, beliefs, and techniques they all shared in common sons who were gang members. They are mothers who care but have to face alone the battle of raising their sons in a community lost to gangs. In Horton's article we are introduced to three different families whose sons are involved with gangs. Teresa Rodriguez who still feels foreign and timid about the culture of America. Maggie Garcia who was raised in the same neighborhood as her son and believes that loyalty to the neighborhood is just and understandable. Gayle Thomas Kary, because of financial struggles was thrown into the gang community and fought her best to save her son. These young men were all minors living in a society pressured by gang affiliation. Although their homes had loving mothers their gangs had friends, boldness, acceptance, and a way of life. â€Å"There may be several deep-seated, underling motives for joining gangs: â€Å"Those who join gangs are struggling with the classic, desperate needs of adolescence: for the end of childhood; for acceptance as an adult; for sexual, social and economic identity; for status and success; for respect and a sense of belonging†. Sheldon, Tracy, Brown 77) Not all of these aspects are apparent in gang members but at least one is. In Teresa Rodriguez's case her son at thirteen unbeknown to her belonged to the gang Sur 13. Because of his boldness he was shot and the family home has been victim to drive-bys ever since. The bullet missed his heart and fortunately he survived. Still he did not learn his lesson and claimed that he did not care if he died. Finally his mother threatened to send him to l ive in Mexico if he continued to go out. â€Å"He did not want that, so he stayed inside. But that has not stopped him from dressing or acting like a member of the Sur 13. After the incident of the shooting Rodriguez also found out that all three of her older sons were part of gangs. Her 16-year-old threw away his cholo clothes right when he heard about his brother. He had not been with the gang since then. The two older boys are very repentant, but it is the father had always left rearing the children to the mother he did not have a strong, active, male role model. So, perhaps he felt as if he had no other alternatives. Maggie Garcia also has a son who is a gang member but her view and approach to her son’s affiliation is very different. She was raised in the same neighborhood as she raised her son in; she understands how much the neighborhood could mean. During school her son got into a fight with a rival gang member because each claimed a different neighborhood. Her son was expelled and she felt the principal at his school was upset because my son had stated that he would die for his neighborhood, but if he had said that if he would have died for his country, the principal probably would have given him an award. This mom understood that the danger in the inter-neighborhood conflicts that her son gets into because other family members have been lost to such conflicts. Sadly this is not enough for her to forbid her son from being with his friends. She feels that by doings so would be like her son telling her not to be with her friends. Garcia follows similar problems as the Rodriguez family; she mentions her history and connection to the neighborhood. In this story the father is also absent and the mother supports her son and find it difficult to believe that her son is wrong. She does not have a bad relationship with her son but he receives no discipline or clear-cut parameters from her. She seems to feel that he is loyal to his friends and at times perhaps takes his loyalty a little too far. Garcia seems to adopt the â€Å"boys will be boys† attitude and does not want to believe that her son may be committing crimes or may be with the wrong crowd or may be in a gang. When he was arrested she insisted that he was just in the wrong place at the wrong time. She could not accept that maybe he is doing wrong and that he should have known better than to be in such situations. She tells him to stay out of the fire but her words are not strong enough to keep him out. Although she is not a bad mother, she is not giving her son reason to stay out of gangs. Because she could no longer afford to live in a community where her son had more opportunities and alternatives her son joined the only other thing, the gangs. The story of Gayle Thomas Kary may be the saddest one because the she tried everything and when she finally thought she succeeded her son, Jamee, died as a result of gang violence. Kary did more than the others, discipline, rules and action. When she caught her son cutting up soap to look like cocaine she sent him to his father, perhaps a change of venue would make the difference, but three weeks later, his dad sent him back because he couldn’t control him. She tried reasoning with him telling him â€Å"†¦ fast life goes fast. â€Å"(Horton) When he was arrested for possession of cocaine Kary was highly relieved but to her disappointment he was let out on probation. Kary refused to accept him and he was sentenced to juvenile hall and a youth camp. When he was released he had a probation officer Kary could turn to. Jamee was tired of life on the streets and his probation officer convinced him to turn himself into a youth facility away from Los Angeles. Finally things were turning around and he really seemed to have changed. He was like the child she use to know Unfortunately when she let him go out with his friends to get something to eat he was shot and died. She did everything she could but still she could not save her son's life. Unlike the other two mothers Kary was really able to turn her son Jamee around. She finally made him understand and she can say that his death was an accident. He was not just a number or a statistic of children lost to gang violence. Although, these mothers were, loving they could not help that a major factor was absent from their son’s lives, their fathers. The fathers may have been there but none seemed to take an active role in their children's lives. Parents can make a difference in their children's lives but many times they cannot do it alone. Gangs are not only the problem of the parents it is a problem of society. â€Å"To prevent gangs, society, police, and parents have to work together to keep gangs out of neighborhoods and also to address the existing gang problem†. Ojile) It may be easier to blame the parents but the truth is the parents are not only the ones to blame. We have to realize that in a society where gangs are the neighborhood it could be our son, our daughter, our nephew, etc. that is lost in the gangs. Burns

The skin, an important organ that acts as a natural cover and holds our many underlying components together, important in multiple functions, yet it can be so easily marred. Burns, one of the reasons for skin damage, are the destruction of the different layers within the skin by exposure to excessive heat; heat that is greater than 120 degrees Fahrenheit, or by friction, electricity or chemical substances. The heat from the exposure cannot be distributed fast enough in the rest of the body, resulting in a breakdown of tissues exposed to heat.Unlike other tissue damages, burns can cover a wider range of surface area. The causes may come from a variety of events such as boiling liquid, exposure to harmful chemicals, or electrical shock. Signs that indicate a burn may be swelling, redness of the area of damage, and pain. Burns are categorized by degree based on the duration, size and severity of injury; the least severe being first degree burns, second degree burns and the worst, third degree burns. Not only are there the regular, common burns that would first come to mind, but there are also chemical burns and electrical burns.Chemical burns occur when the skin is exposed to a corrosive substance that consists of either a strong base or acid. Electrical burns are cause by contact with electric conducting objects that are live. Types of treatment are determined by the severity and also determine the place to which the person should receive the treatment. Regeneration of the damaged tissue will differ accordingly to the type of burn. First degree burn, it refers to the superficial damage to the skin and causes only local inflammation.The inflammation consists of pain, a small amount of swelling, dryness and redness. Peeling, of the area affected, may be seen. This type of burn will only have an effect on the epidermis. Examples of first degree burns include sunburns, flash burns or any other burn that derives from a brief exposure to severe heat. Treatment for this type of burn depends on the location, cause, extent of the burn and may include cold compresses, skin soothing ointments or pain relieving aspirin. The skin usually heals within a time span of a few days without permanent tissue damage.Second degree burns affect the epidermis and the superficial dermis layer of the skin. The burn is often characterized by moist blisters, skin lesions, and bits of shredded epidermis. Also, the injury is often displayed as white. The area of damage is prone to high risks of infection and victim experiences intense pain around the area. In a lot of cases, second degree burns are the consequences of exposure to flames, scald inducing events and contact with chemicals, electricity or hot objects.The treatments for second degree burns depend of the same characteristic of first degree burns. Second degree burns include the addition of extra care to prevent infections. The skin heals within about 3 weeks and 6 weeks if the wound is superficial or deep, as the skin re-epithelializes. At the end of healing, there is minimal scarring to no scarring at all although discoloration of the area may be present. A third degree burn, also referred to as a full thickness burn, destroys the epidermis, the entire dermis beneath it, injures the subcutaneous tissue, and may spread to the muscles.Accessory structures are destroyed. The area of the wound may appear white and leathery due to the damages done to the blood vessels and nerves. The affected skin may also appear black, yellow, or even brown and is painless due to the impairment of vessels and nerves.
